Compliance to the Long Term Insurance Act is a requirement for all Financial Services Providers. This is monitored by the Financial Services Conduct Authority (FSCA). Clients’ are mandated and this mandate in no way imbues any rights on the business or any corresponding liability on the part of the licensed Financial Services Provider for any business transacted outside the ambit of this mandate.


It is recorded that this mandate is a special purpose vehicle for the purpose of establishing a conduit whereby financial services as contemplated in the Financial Advisory and Intermediary Services Act (the FAIS Act) can be provided to consumers in a controlled environment where the aims and objectives of the FAIS Act are regarded as paramount.


Exodec is a Financial Services Provider and Administrator that renders intermediary services in relation to the administration of assistance policies on behalf of the Insurer to the extent agreed to in terms of a written mandate between the insurer and Exodec, this also includes binder holder functions as per the agreement between Exodec and the Insurer and defined in the Regulations under the Long-term Insurance Act.

Compliance requirements include the following as an example:

1. Back up procedure

2. Proof of second bank account for premium collection

3. Monthly Financial summary / Balance sheet – The FSCA wants to make sure client funds are managed correctly.

4. Quarterly questionnaire

5. Register of Training on Policies and declaration register   

    a. Complaints

    b. Cash Handling

    c. FAIS Act

    d. FICA procedure for Long term insurance

    e. General Code of Conduct

6. Proof of FSP licence displayed in offices

7. Treating customers fairly
